GENERAL CONDITIONS OF SALE

The satisfaction of our customers is our major concern. From the selection of our products to the creation of our models, real quality control is implemented at all levels of our organization. Likewise, we make every effort to respect the commitments we make to our customers, both in terms of order processing, delivery logistics, and the quality of our products.

Terms and conditions

Preamble:

The customer acknowledges having read the general conditions of sale set out below.

 

The validation of any order implies acceptance, without any reservation.

 

The conditions of sale appearing as follows, prefigure the contractual relations between Miss Merry® and her client. This contract is accepted in fact by both parties when placing an order. The rules enacted here will prevail over any other document, whatever it may be.

 Orders :

The e-commerce solution that we have adopted is authentic during the registration of the order, on the nature, date, and time of the order, as well as on the payment.

Miss Merry® undertakes to confirm the order by email to the customer, at the email address that has been communicated to him. The buyer agrees to verify the accuracy of all the information he has entered in his customer account. The seller cannot, in any case, be held responsible for a lack of information linked to incorrect contact details.

The sale is effective only after validation of the order and acceptance of payment.

An order corresponds to a single delivery address. If the buyer wishes two deliveries to two different addresses, he must place two orders, each with a single delivery address.

If generally the majority of the products which we present online are available in stock, it can happen that for various reasons, the updates of our stock do not take place in real time. If the jewel ordered is not available in stock, Miss Merry® will offer you a refund, an equivalent exchange, or a credit of the same value to be used in its online store. This proposal will be made by email, to the email address provided. The customer is therefore required to check his inbox. Whatever solution is chosen, Miss Merry® undertakes to carry out the operation within 14 working days of ordering.

 Prices and carriers:

The prices displayed in the item sheets are inclusive of all taxes (VAT, dock dues, and any other taxes), but do not include shipping costs. These must be added before the order is finalized. Deliveries made to countries outside the European Community may be subject to various fees and taxes, including customs fees and import VAT. These costs are borne exclusively by the buyer.

Acceptance of the order also implies acceptance of the selected carrier. If for any reason Miss Merry® considers that this carrier is not the most suitable for the delivery of a given order, the customer will be notified by email, and a different choice will be mutually agreed.

Payment :

Miss Merry® offers you several secure online payment solutions:

PAYPAL, one of the most secure payment solutions on the internet, offers you the possibility of paying by Carte Bleue or directly via your PAYPAL account, in a secure environment.

All credit/debit card transactions on this site are processed using Pay Pal, which is a secure online payment gateway which encrypts your card details in a secure host environment

Bank transfer (from account to account)

Whatever the payment solution is chosen, at no time will your bank information pass through our online store, it will be directly processed in an encrypted and secure manner from bank to bank via the server of our trusted partners PAYPAL, or other. Your bank details are not known to us, and we have no way of accessing them, let alone retaining them.

In accordance with the provisions of the civil code on the conclusion of online contracts, the contract will be concluded when you click on the button allowing you to confirm your order, after having viewed the details thereof and in particular its total price, and having had the possibility of correcting any errors. You will thus recognize your obligation to pay.

Miss Merry® reserves the right to cancel any order from a customer who has had payment problems with previous orders.

Similarly, for any order awaiting payment (payment by bank transfer), the ordered item remains the property of Miss Merry® until receipt and confirmation of the validity of the payment.

Miss Merry® cannot be held responsible if an order is no longer available due to the delay in receiving payment. Miss Merry® also reserves the right to cancel an order for which payment has not been received within normal time limits.

Deliveries:

Miss Merry® will use the information as it has been transcribed to it, cannot be held liable in the event of non-delivery due to the entry of an incorrect recipient address.

Miss Merry® undertakes to process any order within 48 working hours after its validation. If this deadline cannot be met, the customer will be informed by email.

Delivery will generally take place within the deadlines announced, but it may occasionally happen that for logistical reasons these deadlines are extended. Miss Merry® undertakes to inform her client by email if the failure is attributable to her. If deadlines cannot be met due to the carrier chosen by the customer, Miss Merry® cannot be held responsible for them.

Miss Merry® will systematically provide proof of shipment if it is supplied with the selected mode of transport, on which a tracking number can be found available on the carrier's website. We cannot be responsible for a possible lack of follow-up by the carrier linked for example to a scanning error, or to a computer bug on the website of the carrier.

Miss Merry® will use the information as it has been transcribed to it, cannot be held liable in the event of non-delivery due to the entry of an incorrect recipient address.

Certain elements of force majeure can discharge Miss Merry® from its delivery obligation: strikes, fires, riots, natural disasters, but also the impossibility of being able to supply properly constitute a discharge from this obligation.

Pictures :

All the jewelry offered for sale in our e-shop has been photographed by our services and corresponds to the same as the photo presented. It may happen that for optical or perspective reasons the visuals may appear misleading as to the effective dimensions of the articles. Miss Merry® strives to communicate in each product sheet the dimensions of her jewelry as accurately as possible.

Returns and withdrawal:

Right to retract

As required by Hamon law (law 2014-344 of March 17, 2014) governing mail order, the buyer has a period of 14 days to form an opinion on the product delivered. During the entire period of this period, the latter may exercise his right of withdrawal.

You have the right to withdraw from this contract within 14 days after the day on which you or a third party other than the carrier and designated by you, physically takes possession of the last item. To exercise the right of withdrawal, you must notify us of your decision to withdraw from this contract by means of an unambiguous declaration (for example letter sent by post, or email), to the following address: 85 Rue D`Auriasque, bat H1, app 11, 83600, Frejus, France, or by email, to the following address: maria.missmerry@yahoo.com

Consequences of the right of withdrawal

You must return or return the goods to the following address: 85 Rue D`Auriasque, bat H1, app 11, 83600, Frejus, France, without undue delay, and in any event fourteen days after you have communicated your decision to withdraw from this contract. This deadline is deemed to be respected if you return the goods before the expiration of the 14-day deadline. In the event of your withdrawal from this contract, we will reimburse all payments received from you, including delivery costs (with the exception of additional costs arising from the fact that you have chosen, if applicable, a method of delivery other than the less expensive model than the standard delivery method offered by us), without undue delay and, in any event, 14 days at the latest from the day we are informed of your decision to withdraw from this contract.

 

Refund

We undertake to reimburse the product returned within 28 days. We can postpone the reimbursement until we have received the goods, or until you have provided us with proof of shipping of the goods, whichever is the earlier.

We will reimburse using the same means of payment as that which you used for the initial transaction unless you expressly agree to a different means. In any event, this means will not incur any costs for you.

We bear the direct costs of returning the goods.

Consumer responsibility

Your responsibility is engaged only with regard to the depreciation of the good resulting from manipulations other than those necessary to establish the nature, the characteristics

All complaints will be carefully examined by our team, for whom customer satisfaction is the primary objective.

Miss Merry® deploys its energy at all times to eliminate any error or omission, both in its supply chain and in the logistics put in place to ensure the best deliveries, as well as in the online presentation of its jewelry.

Good faith prevailing, Miss Merry® cannot be questioned beyond the amount of the order and clears itself of any error or omission that may remain in the information provided to the customer.

 

Terms of use

Miss Merry® only grants visitors to www.missmerry.fr an authorization to view its content on a personal and private basis, to the exclusion of any public viewing or dissemination. The reproduction authorization is only granted in digital form on the consultation computer, for the purpose of viewing the pages opened by the navigation software. Paper printing is authorized for private copying, for the exclusive use of the copyist within the meaning of article L. 122-5 2 ° of the Intellectual Property Code. The creation of a hypertext link on www.missmerry.fr is authorized without frame to the address of the home page of the site www.missmerry.fr to the exclusion of any other address.

Any other use not expressly referred to herein is not permitted and requires the express prior written consent of www.missmerry.fr. Not allowed, in particular, outside the uses expressly granted above: to reproduce brands and logos of the Miss Merry® company, to create deep hypertext links on any element present on www.missmerry.fr other than the home page, to use or extract all or part of the databases as well than any programs or cgi used by www.missmerry.fr, etc.

By using the website www.missmerry.fr, you accept the conditions of use described above, without prejudice to any recourse of a contractual or tort nature which may be exercised by www.missmerry.fr. By creating an account on www.missmerry.fr, you agree to receive information emails from www.missmerry.fr. In accordance with articles 38 and 40 of law 2004-801 of 06/08/2004, you have the right to access, rectify, and delete data concerning you. This right can be exercised online by sending an email via the contact form

Any litigation relating to the interpretation or the execution of a contractual engagement envisaged on www.missmerry.fr will be of the exclusive competence of the French courts applying French law.

These conditions of use, as well as the general conditions of sale and prices, are expressly approved and accepted by the customer when placing and validating by him his order.
